Interesting theyre trying to block his marriage. They were previously engaged so do they have grounds to stop it or just wishing and hoping?

Massachusetts has a law that a spouse can't testify against their spouse. They are trying to block it so they could make his fiancee testify.

yeah, i understood why they wanted to stop it, just if they had the grounds to actually do so legally speaking. if theres a law that somebody involved in an ongoing investigation cannot get married while detained or something along those lines.

I have no idea if there is any legal precedence.

They may not be able to stop them from getting married, but they could make it ridiculously difficult...i.e., they won't allow it to be conducted on the prison property...and he won't be allowed to leave prison...

Maybe that is possible. Don't know for sure.

The marital privileged does not extend to crimes that occurred before the marriage.

It doesn't matter if they get married or not. If his fiancee has info about the murders, she can be compelled to testify and doesn't have protection.

I haven't read anything, but I find it hard to believe they can do anything about him marrying his fiance, and I believe it would be wrong for them to do so. It would be one thing if he married some random friend who was a key witness, buy for all intents and purposes she's his significant other. Just because they don't have a marriage license right this moment doesn't take that fact away.
