So if S.I. had a clear chance to dig deeper and find the "truth" but didnt, due to their own negligence, they could still be held liable, even though Ray is a public figure?

Ray would have to be able to prove it was a lie and he would have to show damage to his reputation. I would think that SI would probably win that case given that Ray is a public figure and that they invoked this Ross character throughout the article. They could argue that the failure to include the words "allegedly" or "reportedly" was mere errata. They would probably prevail upon a showing that Ross at least told them about this supposed video.

It would have to be obvious that the statement was harmful (pretty clear) and was untrue (less clear). If they didn't check the source, they would invoke Ross's interview and say that it was not obvious to them that the story was untrue. But that would only come out well into discovery -- because to prove that, you would have to prove what Ross said and how you documented it. You can only get that in discovery unless Ray's legal team stipulates to it (which they wouldn't). It would still be one hot legal mess -- which SI should be keen to avoid I would think.

This story doesn't pass the smell test. It's not news, it's gossip.

    1. This company, S.W.A.T.S. sells deer antler velvet and holograms and other whacky sounding new age products. Sounds like snake oil to me, and it's very expensive at that.

    2. S.W.A.T.S. allegedly records conversations with celebrities purchasing their product and they drop celebrities names linked with using their products. Heath Evans is one such endorsement and also allegedly the Auburn defense. They have recorded college players when they had an opportunity to give a presentation. Does anyone else think these guys are sleazy?

    3. Just before the biggest media event of the year they decide that is the time to go to the media with this. Right now every possible sports media outlet is covering this story. The impression is that Ray Lewis is a great athlete and because he used the product, it must be the best stuff out there. For their effort they get the benefit of having millions of dollars worth of free publicity by floating this story out there now. They claim on their website that the product is banned pretty much everywhere, but that there is no testing available to catch users.

Does anyone question their motivation, especially considering the timing of this?

When ordering the spray on their website, the following message appears:

Due to such a high demand because of recent news coverage, the delivery of the Utlimate Spray will take at least 15 days for delivery. Thank you for your patience.

The media stooges are willing accomplices. There's a ton of products on the internet that have unsubstantiated and outrageous claims all over the place. The question is, do you believe Ray Lewis purchased this product over the phone? Or do you believe the company (who is also the only beneficiary of this story) has manipulated the national sports media? Ray is an athlete with the money and access to the best out there, this company is definitely not that.

It would -- unless you were illegally taping somebody and did not want to be subject to prosecution.

Who says you can even hear Ray on the tape?

Like I said earlier, it could just be a tape of the guy talking into the phone, and the other person on the line could be anyone.

Unless he was on speaker phone.

I highly doubt a video camera would be able to pickup the audio coming through the transceiver, since it would have been pressed against the guys ear.

Well they've admitted to the recording so how does hearing it make a difference in this case? It would make a difference with the accusation though.

The entire thing is highly suspect.

It appears it was highly calculated to get the most press, and then reap the most benefits (in terms of sales).

The message on their website further aids my suspicion.

    THIS DESERVES A NEW THREAD!!!

Watching ESPN, 2:30 NFL segment, and signing off, the ESPN reporter said about media day in closing, "although Ray Lewis did his best to dodge whatever questions he could"

I've been replaying it to get it right.

Apparently he didn't purchase it, it was just sent to him, I guess so they could use him as an endorsement. Which in a way makes the whole thing shadier, what proof do they have that he ever even received it or intended to sue it if he didn't pay for it.

doesn't matter though, Ravens fans are the only ones asking these questions. The media is willingly fueling the fire for viewers and opposing teams fans are believing what they want, posting comments on stories like "of course he needed to get his triceps right ASAP, you can't do the stabbing motion without it". Anonymous internet comments are sending us down the shitter.

    Timeline.

After Dallas game, Ray is in hospital getting tests done on eastern time.
He calls this guy on SUNDAY NIGHT DALLAS TIME! So, this guy 'happens to be in his office Sunday night" to record a spontaneous call, C'mon.
You really think this businessman who has $ is on a Sunday night laying around his office 2 hours later than Baltimore time? Really....
Then he can set up video/audio tape of conversation? If he is credible does he audio/video his clients?
    This is total BS..
Anyone who beleives this is a total idiot and the media should be held accountable for falling for it.

people need things to talk about.

From a business point of view, good publicity or bad publicity is good marketing, this guy got tons of FREE publicity to sell his crap. He just made millions today selling his junk to fools in gyms looking for an edge. Very shrewd, scumbag.
